Samoa's Trade Marks Act and Patents Act provide that an independent application can be filed or an application can be filed on the basis of any "overseas" registration. Such application must be filed within 2 years from the date of the overseas registration. All applications need to be advertised and oppositions can be filed.

Samoan trade mark registrations are valid for 14 years from the date of registration and registrations based on overseas marks are valid for the term of the overseas registration.

The Samoan Trade Marks Office has a computerized catalogue of all trade mark registration and details of all registrations are manually collated chronologically. Searches can be carried out manually.
