- Fiji’s Patents Act is outdated (close to a century old)
- You can file either an independent patent application or an application based on prior United Kingdom registration (within 3 years of the grant of the UK patent)
- UK-based patents are valid for the term of the UK patent
- There are no qualified patent attorneys in Fiji. To file a patent application the specifications need to be prepared offshore
- Independent patent applications are advertised for opposition purposes, examined in Australia and take a long time (usually years) to register.
- UK-based patents applications are registered much more quickly, are not advertised and are registered “as of right.”
